The Economic Consequences of Divorce<\/h4>

Divorce should not be undertaken lightly, not just because of the deep emotional consequences it can create, but also because of the economic consequences that follow a divorce. Once a couple has filed for divorce, the marital property will be divided, either by agreement of the spouses through a written property settlement agreements or by order of the court. This property division will determine the ownership of all marital assets, including savings accounts, retirement accounts, real property, debts, vehicles and personal effects.<\/h6>
Other economic consequences of divorce include spousal support and child support obligations. Spousal support may be predetermined according to a prenuptial agreement or it may be agreed upon by the spouses during the divorce proceedings. If the spouses cannot agree on the issue of spousal support, such support will be determined by the court. Child support, unlike spousal support, is a legal right of the children and can be set by the court according to statutory child support guidelines.<\/h6>

In Virginia, an absolute divorce (also referred to as a \u201cDivorce a Vinculo Matrimonii,\u201d or Divorce from the Bonds of Matrimony) may be obtained by no-fault grounds or fault grounds. No-fault grounds for divorce are established by living separate and apart continuously for one year. If there are no children under the age of 18, the spouses may be granted a no-fault divorce after living separate and apart for six months if they submit a written property settlement agreement to the court.<\/h6>
