Uncontested Divorce vs. Contested Divorce
If divorce is inevitable, you can have either a contested or an uncontested divorce. A contested divorce is when two parties cannot come to an agreement. An uncontested divorce is when you have come to an agreement on the issues. In an uncontested divorce, the sides agree on all of the issues in the divorce. This may include:
- Child custody
- Spousal and child support
- Marital Property
Even in a contested divorce, it usually makes more sense to come to an agreement with your spouse rather than to fight to the end. If you and your spouse are unable to come to an agreement, a judge will decide the terms of the divorce decree at a final hearing.
